Adoptable Terms of Service

Please read all of the information below before purchasing/bidding on an adopt!By bidding/purchasing an adopt/design from me you agree with all of the terms laid out below.If you have any questions please feel free to ask me!

✦ General• An account must be a minimum of 5 months old in order to bid.• If I am uncomfortable with the winner of an auction, I have the right to refuse to sell the design to them.• Any violation of the terms/rules mentioned below may result in being blacklisted/banned from purchasing designs from me.
• You can't claim the art or the original design as your own.• You can't drop, hide a bid comment or edit your bid. Be sure when you bid on my adoptable, If you break this rule I can put you in the Blacklist and deny you to buy again from me in future.

✦ Payment• Reserving/hold is only for trusted people who bought something from me before.• Once you have won the auction, I will note/contact you shortly after.• Payment/ must be made within 24 hours of winning the auction.• Payment plans can be discussed if price exceeds $150.• If using a payment plan, the minimum payment to be made upon purchase is 25% of the final price.• Payment plans may be 1-2 months long depending on the price.• You do not own the design until you pay off the design in full. Once you have paid in full, I will send over the full res. file(s).• If you fail to pay off the design in full in the time agreed upon, no money will be refunded, and I will have the right to resell the design/put it back up for auction/keep it, etc.• NO REFUNDS ARE GIVEN. Please be sure you want to purchase the design before bidding.

✦ Usage• The design is for personal use unless commercial rights are bought.• You may give the character a name, story, etc.• You may make small changes to the design, but the overall appearance/theme must stay the same.• Given it is not a part of a closed species already, you may use the design for someone else's closed species.• Please credit me where necessary.• No one is allowed to mint my artwork as a NFT (Non Fungible Token); my art, whether commissioned, pre-existing or future, can not be minted into an NFT by commissioner nor anyone else. I strictly prohibit usage for AI learning.

✦ Commercial Use• Commercial use Required an increment of Price, minimum +100% of the original Price , to +350% Max. I do not accept payment plans for commercial use fee, payment must be done in 24 hours.• You can sell your personal product, but you can't sell my original drawing of the design (for example you can't put my drawing on a t-shirt and sell it , but you can do a drawing by yourself of the design you bought from me and sell it on a t-shirt if you paid the commercial use). You bought the design, not the art or the intellectual property, this will belong always to me, I will be always the author.• For commercial use I need to know where you intend to use my designs to decide about it and be credited as the creator with a link on my page, in any case contact me ALWAYS before and tell me about your projects, the price can change depending on what you have in mind to do, big or small project.• The use of the design as vtuber model is considered commercial use, so if you Intend to use it, ask me about the price.• The increment for vtuber purpose or commercial use start from minimum +100% the original Price to max 350% the price you paid , depends on the original adopt cost and your purpose, the less the original price is, more high the commercial fee should be.• Minor change is accepted but need a check by me, the main features of the character must be preserved also in commercial use purposes, you can give to your character a new outfit and in any case I need the credit on the pages you intend to use my design.

✦ Reselling/Trading• You may NOT resell for more than the price you bought it for. The only exception is if you commissioned artwork of the character. You may sell commissioned artwork as an extra cost with the character, but only for the same price you purchased the commission for. Unless the commissioned artist is not ok with this. Please check their TOS so as not to break any of their rules.• You may resell it for the same price, or lower than you purchased it for.• You may also trade/gift it as you please.
